3. In other news of the day: The Senate will vote on DeVos at noon. I am not personally hopeful that another GOP Senator will vote against, and I expect a tie w/ Pence breaking it. Even if this happens, though, and she IS confirmed, I'd argue that the sheer outpouring of anger and media attention has been a net gain. It has brought enormous attention to how much dissent there is, and how shitty of a choice she is. It's a significant show of the powerful resistance against Tr*mp. Yes, it'll be a huge disappointment if she's confirmed, but we will need to just keep protesting her and drawing attention to her incompetencies. And, the Senators who DO vote to confirm her will HEAR IT from their constituents who've been calling, showing up, and raising hell. THAT will be a gain, for sure.
Also, the 9th Circuit Court of Appeals in SF will hear oral arguments (over the phone) this evening, as the Justice Dept files their reply brief and tries to convince them to reinstate the Muslim + Refugee Ban. If the 9th Circuit (the most liberal appeals court in the country) rejects the Justice Dept, it's highly likely that the Ban will go to the Supreme Court.
